These Terms of Service govern your use of The Fairway Report (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Your Account

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity under your account.

3. Permitted Use

We grant you a personal, non-exclusive, non-transferable license to use the Service for its intended purpose: viewing and sharing golf course condition information.

4. User-Generated Content

• You retain ownership of the condition reports, comments, and photos you submit.
• By submitting content, you grant The Fairway Report a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content within the Service, including displaying reports and approved photos publicly to other users.
• You represent that you have the rights to any photos you upload and that your content does not infringe the rights of any third party.
• Photos are reviewed by an administrator before publication; we may reject or remove any photo at our discretion.

5. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent condition reports.
• Upload content that is unlawful, harmful, harassing, defamatory, or that infringes the rights of others.
• Attempt to disrupt, overload, or gain unauthorized access to the Service.
• Use the Service for any commercial purpose without our permission.
• Impersonate another person or misrepresent your identity.

6. Disclaimer

Condition reports and ratings on the Service reflect the subjective opinions of individual golfers at a point in time. They are not professional advice, official course ratings, or guarantees of course quality or playability. Course conditions change frequently and a report may be outdated. You use the Service at your own risk. The Service is provided “as is” and “as available” without warranties of any kind.

7. Limitation of Liability

To the maximum extent permitted by law, The Fairway Report and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service is limited to the amount you have paid us, if any.

8. Indemnification

You agree to indemnify and hold The Fairway Report harmless from claims arising from your user-generated content or your violation of these Terms.

9. Account Termination

You may delete your account at any time from your Profile. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion.

10. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Texas for any dispute arising from these Terms or the Service.

11. Changes to These Terms

We may update these Terms from time to time. We will indicate the date of the most recent revision at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
